Definitions:
User Agreement or Agreement - This document and all of the included text and provisions.
World Testing Inc - the owners, managers, representatives, employees, vendors, providers, or families of World Testing Inc, including any website , data, or computer managed or under their control.
Visitor - anyone who visits, contacts, or uses World Testing Inc, it's information, Website , content, or services.
Website - any content stored on or delivered by a server, connection, or computer under the control, use, or management of World Testing Inc.
Content - any data, information, advice, text, images, programs, scripts, applets, computer code, downloads, audio, video, or links contained within or referred to by way of the website .
Agreement:
This AGREEMENT is entered into between VISITOR, and World Testing Inc and shall be governed by the laws of the State of Tennessee without regard to its conflict of law provisions. VISITOR and World Testing Inc agree to submit to the personal and exclusive jurisdiction of the courts located within the state of Tennessee. The failure of World Testing Inc to exercise or enforce any right or provision of this AGREEMENT shall not constitute a waiver of such right or provision. In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.
Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the WEBSITE or AGREEMENT must be filed within one (1) year after such claim or cause of action arose or be forever barred.
1) This agreement may be updated and changed without any notice to the visitor.
2) By using or continuing to use the content provided by this website , visitor agrees to be bound by this agreement and any future updates to this agreement. If visitor at any time does not agree to the terms specified by this agreement, visitor must no longer continue to use this website or it's content.
3) Visitor agrees to hold harmless and will in no way, legally, monetarily, or otherwise, penalize World Testing Inc for visitor's use of this website or it's content whether proven factually correct or incorrect.
4) World Testing Inc makes no warranty of any kind as to the validity of any content provided by this website . Any use of any content is at the sole risk of the visitor. It is the visitor's responsibility to verify the validity of any content.
5) World Testing Inc makes no warranty of any kind as to the accessibility of this website or it's content. This website may be taken offline or otherwise disabled for any reason without notice to visitor.
6) At the sole discretion of World Testing Inc, penalties of up to $1,000,000 plus any damages or court and legal costs incurred by World Testing Inc will be imposed upon any visitor who attempts either intentionally or accidentally to invade, hack, crack, deface, disable, manipulate or impact the performance, or otherwise injure this website , it's content, or any website or content provided by or referred to by World Testing Inc. Payment must be made by money order payable to World Testing Inc and delivered to the address referred to in the " Website Management Contact Information" section of this agreement within 10 days of the receipt of such notice.
7) At the sole discretion of World Testing Inc, penalties of up to $1,000,000 plus any damages or court and legal costs incurred will be imposed upon any visitor who attempts either intentionally or accidentally to harvest or collect any content or information including but not limited to visitor information, membership information, user lists, email addresses, or credit card information that is/are managed, maintained, stored, or otherwise controlled by World Testing Inc. Payment must be made by money order payable to World Testing Inc and delivered to the address referred to in the " Website Management Contact Information" section of this agreement within 10 days of the receipt of such notice.
